Amendment to the Labor and Social Security Registers Act
On 21 April 2023, the National Assembly of the Republic of Slovenia adopted an amendment to the Labor and Social Security Registers Act (“the Act”), which will enter into force on the 15th day after its publication in the Official Gazette of the Republic of Slovenia and will become applicable 6 months after its entry into force.
The amendment addresses the following changes:
- It expands the definition of an employee in such a way that an employee within the scope of this Act is also considered to be a worker who, on any other legal basis, performs work for an employer, provided that the work is performed in person and that the worker is involved in the employer's work process or predominantly uses the means of performing the work that are part of the user's work process.
- It sets the deadline for registering an employee for social insurance and the deadline for submitting information from the register of employed workers.
- It determines additional information to be recorded in the working hours records.
- It establishes employee’s right to be informed (the employer's obligation to inform the employee in writing) and to access the data in the working hours records.
- It introduces the mandatory implementation of electronic record-keeping of the working hours records in certain cases and the possibility for employees to propose electronic record-keeping.
- Finally, it sets fines for violations in respect of record-keeping.
